on a state level there are many times an AG is asked to make a determination about something.

The AG makes his ruling and it is considered law if I am not mistaken

After that happens then if it is contentious somebody takes it to court.

Up until this point I believe it is considered legal

Once the court makes a ruling then it is either legal or not.

At which point if the legislature disagrees they can respond accordingly. To either make it legal or otherwise as far as a statute.

Gonzales ruled waterboarding was not illegal

The way I was looking at it, that's legalizing waterboarding by decreeing it isn't torture.
That wouldn't be 'legal' torture because it's no longer defined legally as a torture technique...but but it would be the legalization of a specific torture.

Semantics.....it's still torture and the Bush administration rationalized it.
