According to the Delaware State Trooper's office, she was in fact a State Trooper. Here's a link to the actual story. They were fighting it with the state, and were working with their congressman. They were given warnings, but were attempting to fight the issue. Then they lied and told them they could keep the pole, and then took it anyway while the trooper claimed she never said that.

It's fucked up no matter how you slice it. The guy that complained did so because he didn't want to have to slow down for kids playing in the neighborhood. Plus, the hoop most likely should have been grandfathered past any new laws, since it had been there for going on 60 years according to most accounts.
 
The lady was not a cop. She was probably a bylaw enforcement officer and she obviously fucked up when she said he could keep the pole. He had his chance to remove the pole and he chose not to. Bye bye pole.

She told the guy that he had to stop talking and couldn't talk to her anymore. That's a violation of the first amendment. Then she lied to him by saying the would leave it with him, and then not allowing that to happen once the pole was removed.

I agree that THIS sucks, and I reckon he should get his pole back AND a fine waiver AND an apology from lying cop...but the pole shouldnt be over the road, and thats the law, so suck it up.

Then the reporter files this as part of the story..... " Moments later, after the pole is removed and put into a truck, the same trooper denies she ever made such an offer. " It seems the reported dubbed her a trooper without confirming it. Typical reporter. :24: It also said this " John McCafferty said the woman never clearly identified herself or which agency she was with but just issued orders. " Nobody ever bothered to ask her either. :24:

She didn't look like a trooper to me due to the fact she wasn't wearing a uniform.

Furthermore... there was no need to confiscate the poles, they could have been left on the owner's property (which is where they were to begin with before removal).
Why leave the pole with the owner? All he would do would be to put it back up as soon as they drove off. It's clear he wasn't following the law or the numerous written warnings or notices he received. That's why the authorities had to show up and remove the thing.

According to who's accounts? The neighbors? :24: I doubt any of them have lived there for 60 years and even if they did that pole ain't no 60 years old. Look at the bloody thing. Besides that why would you grandfather a pole? A new law was enacted for the safety of the general public and the pole has to go. It's quite simple.

The resident stated he was in touch with his congressman which imo is the smartest thing he's done but until he gets the law changed with the help of your democratic process the pole has to go.

That would be his mistake if she wasn't a trooper.

To be honest I am really interested to see if in fact she is a trooper and I don't know why that is. It really doesn't matter what she was other than a person just doing their job.

Anyway, it's all political correctness gone mad. Who gives a fuck about basketball hoops?

I agree it's a bit carried away and I suspect the real reason the guy filed the initial complaint was for no other reason than he got tired of listening to the constant thwap thwap thwap of the ball hitting the pavement. Keep in mind there were a few other poles in the back of that dump truck so it was a general complaint and not one directed just at the guy that was being an idiot.

We were playing street hockey and the cop threatened to take down away our net. He said it was gone if he saw us out playing again.

In our case it was more justified. The street has more traffic than a cul de sac. Although with common sense by those playing there would not be any danger.

Anyway having said that the guy is question is a jerk. The law is a law and there would be no grandfather clause for something like this when public safety is involved. And Guy is right. I would bet a dollar if he were to have kept the pole that it would have been back in place in short order.

No way the woman is a police in my opinion. They do not send out nonuniform officers for stuff like this. That is why the sheriff was there. She would be a DelDot supervisor. As to the telling the guy to not taunt that is justifiable if he is a public nuisance and stirring shit. Remember the black professor who got arrested and Obama got involved. He was arrested for inciting. Just because you are on your own property does not allow you to have carte blanche. Inside the house is a bit different. But outside the concern is causing others to get involved. In a worst case example it would be something inciting a riot

Who gives a flying fuck? You act like it was your fucking hoop.... Obey the fucking laws and you won't have trouble with law enforcement. If the guy was pissed he had to slow down for kids maybe he shouldnt go so fast and maybe the parents of said children should whoop their ass for playing in the street.

He called her," officer", and she didn't correct him. She also stated that she would arrest him. That would lead one to believe that she was acting in an official capacity as as law enforcement officer. She didn't say, "I'll have this officer over here arrest you". She stated that she would arrest him. At least as neare as I could tell.

If it was someone acting in an official capacity telling me I couldn't talk ot them and that I had to go back into my house, yes that's infringement upon one's first amendment rights.

The big picture here isnt that the poles had to be removed. If thats the law then thats the law. Not just for the safety of the people in the streets but also the cars possible hitting the pole and what can happen

The issue is how it was it was handled by the troopers. and if you cant see that, the you need to remove your head out your ass.

There's nothing to investigate. It's against the law. If the law gets changed, which it won't, then he can put a pole back up.
