nope, they can use anything you say at anytime. The miranda rights just remind you to shut the fuck up. Which you are a complete fool to ignore.

Mirand rights are only given after you are placed under arrest. You might only be answering a few simple questions and be placed under arrest after you say something you shouldn't have. But it's too late at that point, you already sunk your ship.

I am not sure about the US so I will ask you and if others want to pipe in they can..

What if you were just in an accident, such myself, and you had ambulance and firemen all around you asking you all sorts of questions and did not notice the police officer, mostly due to injuries and trying to stay alive, ask you if he could draw blood and in the hustle of questions you answer yes to a question and he assumes you said yes to his ? For the sake of argument, lets just say you did answer him anyway, with Trauma, are you not impaired and immune and is his question not entrapment by your laws ?

That's a gray area that would need to be addressed by the courts. It would turn into a he said/she said kind of thing and you would be fighting an uphill battle since it's your word against the word of a police officer.

I have no problems w/ my vehicle being searched, no. The most interesting thing they're gonna find is my geocaching log. Now if they tore my car apart searching it (b/c they can remove seats, gas tanks, etc and have no obligation to put it back) I'd be rather pissed just b/c of the damage...but searches I have no problem with.

Just so I'm clear... you wouldn't have a problem if you were pulled over because the officer decided you looked funny, and then proceeded to destroy your car looking for "something". All because he thought you might look suspicious?

I dont agree with random stop and searches by the police, not because I have anything to hide but because they are abusing anti terrorist laws which wern't for this purpose, to search me and frankly it gets really annoying when they keep doing it.

I gotcha. But I guess I don't see much of a difference between searching and destroying. Either way it's a personal violation of your property without real probable cause.

What about if you had naked photos of yourself or your partner in your wallet/ car or home? Would you be happy about strange police officers seeing them if they were just randomly searching you without any decent reason?

LMFAO...well, I would NEVER carry those...so I wouldn't have to deal w/ that. ;) But I have strange friends who think it's funny to send me texts of people shitting on each other OR their own bowel movements...if someone wanted to search my phone (and my job has the right to do so if I bring it on the property) I might be a little embarrassed but, more than likely, I'd just end up laughing about it. I did have a friend whose house got searched one day and she had to pull the female cop off to the side and tell her where her "toy box" was and ask her to please search that herself instead of letting the male cops do it.

They had a huge case full of coke on the table and the photographer told them not to open it as it contained undeveloped film and the light would ruin it.:D
