I looked this up out of curiosity..

From what I can find.. The following are examples of unconstitutional examples for the US..


  • A politician who abuses or acts outside of the powers of his constitutionally-established office.


  • A legislature that tries to pass a law that would contradict the constitution, without first going through the proper constitutional amendment process.


  • Any person acting on behalf of the government who tries to prevent an individual from exercising individual rights which the constitution protects (such as the right to vote or to practice religion).

Much debate often surrounds controversial laws enacted by state legislatures and the United States Congress regarding the laws' constitutionality. There are different forms of constitutions. The United States Constitution is a "rigid constitution". Rigid constitutions cannot be modified in their express terms, except through such processes the constitution itself ordain.

Which is why I have always been saying...the same sex couples just need to forget the word marriage ...then come in from a different angle with a different term asking for the same rights as marriage.

I don't intend to provide the various court decisions, only that they've been made and that gives compelling strength to Accountable's arguments.

In other words, I don't have to......eight federal courts, including the First and Second Circuit Court of Appeals did.......and in a debate...it would be up to you to prove otherwise.

Yes.....the constitutionality of The Defense of Marriage Act. .....generally, limiting the legal concept of marriage to one man and one woman.
Whether you agree or not to the morality of same sex marriage, the issue is whether the legislators can write that Act since the Constitution sets the boundaries of Federal Law.
Accountable's argument is compelling and as I noted, courts are seeing conflict.

I suspect the issue will become the domain of the States and that is occurring.

I show this first because it is the foundation of my argument. True, I put it in a post that wasn't addressed specifically to you, so I'll show others that were.


What makes something unconstitutional is that it is not constitutional. Being unable to prove constitutionality proves unconstitutionality.


I agree that marriage is not a natural right, and as such is not protected by the Ninth Amendment, but without specific mention of marriage in the Constitution, restricting it violates the Tenth Amendment.

DOMA clearly violates the Tenth Amendment. Conservative statism is still statism; it goes against the most basic tenets that formed our decentralized representative republic.


Now since you have already agreed that "A legislature that tries to pass a law that would contradict the constitution, without first going through the proper constitutional amendment process" is what defines an unconstitutional law, and DOMA clearly contradicts Article I Section 8 and the Tenth Amendment of the Constitution, then DOMA is clearly unconstitutional.

Arguably falls under the Commerce Clause as creatively interpreted and re-defined. I think it was a horrible idea, but I'd have to research to give an opinion of its constitutionality.

I think I understand where you are coming from ACC but dont think it applies...In others words DOMA doesnt have to be in relation to the constitution, In other words a law cant be unconstitutional ...but they pretty much make laws all the time..and if they are not constitutional then they dont fly....here is a partial list from the recent past...as we can see many of them are just laws.
DOMA is essentially just a definition of marriage.
If you start reading below we can ask the same question with number 2 for instance "December 9, 1991: High Performance Computing and Communication Act of 1991"
What provision is the constitution does it support...it doesn't..but that doesn't make it constitutional.
So my question to you is...what part of the constitution does doma violate and how.
Your argument is different than the standard argument...the standard argument is that it is discrimination....which almost holds water..but not quite.
