A law dealing with child abduction

So I thought up this idea for a law dealing with child abduction... I'm thinking of making a bill for it for debate. Anyways, I wanted to see what your guy'ses thoughts on it are:

If an abducted child is returned, safely, without physical or sexual abuse, no charges will be pressed against the abductors.

Thoughts?

No I am. It would be an incentive for child abductors to return children to their parents. If an abductor took a kid for ransom, then changed his mind, but was afraid of returning the kid, then we could ensure no charges would be made against him.

Wouldn't you prefer the child being returned safely over the child being murdered and sending the guy who did it to prison?

Kidnapping is a felony, you can't just waive felonies... unless it's some sort of high-profile sports star or celebrity of course.

they are taking the child for a reason...i'm sure they aren't just going to give the kid back, would be nice to think. I'd rather see them in prision. And if there was a law like yours I would find them and they would be 6 feet below in the backyard.

as a father of the most beautiful little girl in my eyes id say prosecute no matter what. abduction is a vary serious matter and the abducter should be prosecuted to the fullest no matter how the child is returned

Your "incentive" to return ignores the lack of fear in making the abduction in the first place and is totally insane in the second. Ever considered the "incentive" that prompted the crime? ...JAIL or worse.

But even if the child isn't physically or sexually abused the child is going to be psychologically traumatised from the kidnapping itself. Being taken by force and then not being able to be with you mum, your dad, not knowing what is going on or when/if you are ever going to see them is really going to upset and taumatise the child.

I am talking about a more rare occurrence, For example:

A guy who needs money and sees the opportunity to kidnap a kid and does it on impulse. After thinking about it, he decides he doesn't want to risk life in prison for money for a ransom. If he had the choice of murdering the kid and possibly being charged with murder in the future or returning the kid safely and having no chargers, what do you think he would choose?

Even if this law only saved ONE kid it would be worth it.

Fuck no. A reduced sentence maybe, but if you kidnap a child you deserve to go to prison. And not some county jail, but federal get-raped-in-the-ass prison.

So you're choosing the offender over the victim. AKA you would rather send an offender to prison then save the victims life.

Yes but what about the psychological impact on the child.

Yes he doesn't murder the child but the child isn't going to come out of this all happy, everything is dandy. It's going to traumatic for the child and the guy deserves to be punished.

Some kidnappers might find it getting to hot and heavy, and just want out. This would give them a second option to simply killing the child.

oh that would make me feel comfortable knowing i could be living next to someone who abduted a chilld but returned them.....THAT TIME

next kid might not be so lucky since he/she would be free just because he returned the first kid safely

I'm not saying he doesn't deserved to be punished--just that I would rather see the child come back home physically unharmed and psychologically heal-able over seeing the perpetrator go to prison. Yes, I would rather see both, the child come home AND the abductor go to prison, but in most instances we don't get both, and usually we end up with the latter.
