Only one person has even been executed in Colorado since it reinstated the death penalty in the 1970s, and that was 15 years ago. Only 3 people sit on death row there now. Even if he does get the "death penalty", he'll likely be spending the rest of his life on death row and dying in prison. Colorado isn't Texas, LOL

The prosecution say they will speak with victims families and survivors before deciding whether or not to seek the death penalty

Only in Texas can you kill someone off your property and get away with it.

Also look up the name "Carols Deluna".

Thank GOD most states aren't like Texas.

Read the Penal Code sections about use of lethal force in my state before you jump to conclusions. Just because someone is acquitted doesn't mean they followed the letter of the law ;)

In California you can practically sever the heads of your ex wife and her boyfriend and get away with it....if the glove don't fit

No, I know. I'm saying that even if he gets the death penalty... he'll just rot away in jail regardless because Colorado is extremely slow to execute anyone.

(Just a not that I'm completely against the death penalty in all cases, just discussing the logistics of this state's history)

In any state, someone with a good attorney should get what they pay for.

As mentioned, there was a case I knew of personally where it turned out that the state FABRICATED evidence to try to convict.

That isn't something that can be used to universally smear an entire states legislation.

Here, word for word.

Protection of Personal Property:

Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
(1) if he would be justified in using force against the other under Section 9.41; and
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:
(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or recovered by any other means; or
(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

Protection of a Person:


§ 9.32. DEADLY FORCE IN DEFENSE OF PERSON. (a) A person is justified in using deadly force against another: (1) if he would be justified in using force against the other under Section 9.31; (2) if a reasonable person in the actor's situation would not have retreated; and (3) when and to the degree he reasonably believes the deadly force is immediately necessary: (A) to protect himself against the other's use or attempted use of unlawful deadly force; or (B) to prevent the other's imminent commission of aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery, or aggravated robbery. (b) The requirement imposed by Subsection (a)(2) does not apply to an actor who uses force against a person who is at the time of the use of force committing an offense of unlawful entry in the habitation of the actor.

I just don't believe that the gov't should have enough power to kill one of it's own citizens legally.

1. It is a state by state legislation. And the Federal Government needs to allow states to decide.

2. You have the right to try and vote out anyone who supports it if you choose to do so.

Happens alot more often than people think..in this case though they shouldnt have to though
But many times the state will fill in the blanks with what they need to convict.

System needs an overhaul..like sending those who wrongly convict to prison for life,,that should help alot ;)

First, I believe is the devaluation of the human life. If abortion and assisted suicide are every day occurences then that says those lives have no value.

I'd have to say that this is an entirely separate agenda. Take the assault rifles off the streets, the assault rifle killings cease.

BINGO!

Problem is, many people don't have the money nor resources to prove what the state is doing.

Don't get me wrong, there are some open and shut cases, but laws can be changed to our societies knee jerk reaction and then you have the state and feds abusing those laws.
