Doesn't sound like premeditated murder to me. A 13 year old boy was put in charge of several siblings and his mother delayed response of EMTs?

Charge her with negligence and get the rest of those children the fuck out of that house.

Of course, the thread title is sarcasm and I don't think the death penalty should be used here, but if knowingly beating someone to death isn't premeditation....I don't know what is? I do think the parent shares some responsibility here too.

What the hell do you expect when you leave a 13 year old to watch over younger siblings? This should ALL be pinned on the mother for neglecting all the children.

I don't know any 13 year olds who don't need disciplined.

I think the kid got stressed out. I get stressed watching children and Im 23, I could only imagine how that would effect a kid with no reprieve to the aggitation. That is why adults are supposed to supervise the young ones. We are mature enough to know when to take a moment and breathe.

A thirteen year old not knowing the meaning of murder? The kid would have to live in a bubble to not know what murder was by that age.

But was it malicious and intentional? That's what I'm trying to say.

Did he mean to kill his brother? and would his brother be dead had their mom not obstructed the calls to 911 and the EMT response?

Dude you guys of course the 13 year old knows what murder is. I wouldn't be surprised if he did have a lot to do with this. But ultimately no matter what, in any situation, the Parent supervising the kids is responsible for the minors and their actions...

Well, if you continuously beat someone until they die, I think he knew what he was doing.

The arrest report details a confession by the 13-year-old that he beat his brother in the head with a metal bracket and then punched, kicked and choked him, before finally smashing his head on the ground until he passed out.

He didn't kill him, he beat him until he passed out.

Residents of the Beach Club Apartments said Tangela Key, the boy's biological mother, even tried to keep them from calling 911 as the boy slowly died of a massive head wound, the final blow ending a months-long nightmare for the boy.

"It certainly appears at this point the child has been beaten over a long period of time," Allen said.

This is the MOTHERS Fault. This 13 year old child was NOT disciplined, was NOT looked after. He was allowed to do as he pleased.

You can't expect a 13 year old to police himself let alone his younger siblings.

A lot of physical harm -----> severe injury

excessive physical harm ------> incapacitation and or death




A 10 year old can follow that logic.

I think everyone knows by now I'm totally against the death penalty in any situation.

I think the kid needs therapy and some time in juvi.

No they aren't. Kids can have abortions without the consent of their parents.
Our government seems to like to pick and choose when parents are deemed responsible and when they aren't responsible to what their kids are doing. It is a joke, a real double standard.

Disciplining your child for bad behaviour and a girls choice to abort a child after being raped/making a bad choice are on completely different fields of play here. A teenage female getting pregnant isn't the fault of the parents, it's her own fault (unless she was raped).

This particular 13 year old was apparently never taught right from wrong.

The children should be placed in foster care and the mother should be arrested and thrown in jail for negligence.
