Alabama Grandma, 81, Shoots Burglar With Pistol

MOBILE, Ala. — An 81-year-old Mobile woman who shot a homeless man who broke into her house to do laundry is anxiously waiting to get her gun back.
Ethel Sanders says she was awakened by noise coming from her laundry room yesterday morning so she grabbed her -point-38 caliber pistol and went to check it out.
Police say she saw 25-year-old James Penn standing in his underwear while his clothes were washing.
Sanders fired the gun and Penn, who was shot, grabbed his clothes and took off. Police found him nearby and say he's expected to survive.
Penn will be charged with first-degree burglary once he's released from the hospital.
Sanders has two bad knees and lives by herself since her husband died in 1982, so she bought the pistol a few years ago to protect herself.
But police took Sanders' gun as evidence for their investigation.
In the meantime, there's a hatchet sitting next to her bed.

Anyways, I heard that if you shot someone in your house, even if they're stealing something, you could get arrested.. I think that's bullshit if it's true, but yeah.
 
You have to be in fear for your life. Since she was old and he was young and since she didn't know him and he was in her house, she can legitimately say that she was in fear of her life. That is how it would play out here in Arizona. I don't know about Alabama. But I would imagine it would not be too much different.
 
You're right, and she probably was. How else could she defend herself against someone presumably younger and stronger? Besides seeing how he was in her house in his underwear she probably thought the freak was gonna rape her too.
 
I feel worse for the homeless guy. its pretty sad that there are people in our society that have to resort to that in order to just be clean...
I feel bad for homeless people as well and believe that we should all do our part to be charitable by helping with our money and time. But even though I feel bad for homeless people in our society - it still doesn't justify him breaking into someone's house.
