Then, Marrone said, emergency room staffers insisted on examining his rectum and held him down while he begged, "Please don't do that." He said Persaud hit a doctor while flailing around and staffers gave him an injection, which knocked him out, and performed the rectal exam.

Persaud woke up handcuffed to a bed and with an oxygen tube down his throat, the lawyer said, and spent three days in a detention center.

This man has definately got a winnable lawsuit. It is against the law and against the "standards of care" to force treatment on a patient who is in their right mind, of age, and refusing treatment.

Sounds to me like it was a case of doctors deciding they know best and didn't bother telling the patient what and why they were doing it! Judge seems to be on the ball by dismissing the assault charge against him! If someone tried an 'examination' on me without permission I'd probably do more than 'flail about'!!!:ninja
