67 Year old man beaten to death by Burger King employee

I dunno, this is a tough one to call, even if he did throw the first punch homicide sounds a bit much, not like he was thinking he was gonna KILL the guy with the punch, also it seems the guy was homeless too, not like he just killed a family man who was out picking up lunch for his kids at BK or something, honestly I hope they let this guy off light.

dk I can't believe you posted what I bolded!!! Like it makes a difference if he was homeless or a family man. Punishment, if he was in the wrong, should be the same no matter who he killed! :surrender
 
I have always disagreed w/ someone being charged w/ homicide when something like this happens. We had a case around here probably 20 years ago now where 2 guys got into a bar fight and one of the guys slipped and hit his head on the bumper of a car after being hit. He died due to the brain injury from hitting the bumper and they charged the other guy w/ homicide. I just don't see that it's reasonably foreseeable that someone is going to fall, hit their head on the bumper, and die.
 
Natasha and DA I agree with both of you, shit happens, this really isn't murder in my eyes. IMO Murder is intentionally ending another human beings life, and whether this was self defense or not it definitely wasn't murder IMO. And yeah it's still a tragedy regardless of who the victim is.

Hopefully they will at least drop the charges to involuntary manslaughter w/ the minimum punishment...that is IF the version on FoxNews is correct. If he wasn't acting in self-defense then I say throw the book at him.

The Wayne County Medical Examiner’s Office said today that an elderly customer killed in an altercation with a Burger King employee on Detroit’s east side died of blunt force trauma to the head, and coroners ruled the case a homicide.

It wasn’t clear whether the worker would ultimately be charged. Police are investigating whether Paul C. Cannon, 67, may have caused a disturbance that came to blows at around 2:30 p.m. Thursday before his death from a clobbering by a 20-year-old employee at the fast-food joint.
Police weren’t releasing the worker’s identity. The Wayne County Prosecutor’s Office said it was reviewing the case for possible charges.
Sgt. Eren Stephens, a spokeswoman for the Detroit Police Department, said a verbal altercation between Cannon and the worker escalated into a fight that knocked Cannon to the ground. His last known address was on the city’s west side, but a resident at the home said the house belonged to Cannon’s sister and that he hadn’t lived there for several years. Relatives couldn’t be reached for comment.
Stephens said police were investigating reports that Cannon may have been homeless. The medical examiner’s office said toxicology reports wouldn’t be available immediately.
The worker remained in custody tonight, Stephens said. She said what sparked the altercation hadn’t been verified.
Denise Wilson, a spokeswoman for Miami-based Burger King, said the franchise owner is cooperating with investigators.
“The safety and security of all guests and crew members is a top priority at all Burger King restaurants,” Wilson said in an e-mail.
The owner of the restaurant couldn’t be reached for comment. Employees at the store on Gratiot just north of St. Aubin declined to comment and posted signs that the restaurant was drive-through only.

this is all they're saying right now. a verbal altercation escalated. they appear to be soft-pedaling around the old guy being a homeless drunk.

there was more. i can go see if there is more detail. i saw something that said he hit his head on the way down and didn't choke on his dentures.

i saw one much worse get null prossed for mutual combat where young black guy bounced an old white guy's head off the pavement a few times. the killer just also happened to be a rock slinger for the local mob outlet, had a get out of jail free card and roller skates to go to court on. judge tossed it.

be interesting to see what the real truth is here and how it plays out. no police misconduct for a change. just a tough judgment is what it looks like.
