So who all here gets their policy update e-mails from Paypal and ignores them??? I know a lot of people who do. As a matter of fact, when I just spoke to my shift about the recent policy update, not a single one of them (8 people) realized what they were agreeing to by not opting out.

For those of you in the dark, the latest policy update states that if you don't opt out by sending an opt out notice to them by snail mail, you agree that any disputes w/ Paypal will be handled through arbitration. You're also agreeing that you no longer have the right to take part in any class action lawsuits against Paypal.

Here's the policy update, copied and pasted straight from Paypal:

  • Amendment to the PayPal User Agreement
This update to the User Agreement effective November 1, 2012 contains changes that affect how claims you and PayPal have against each other are resolved (see Disputes with PayPal below). You will, with limited exception, be required to submit claims you have against PayPal to binding and final arbitration, unless you opt out of the Agreement to Arbitrate (Section 14.3) by December 1, 2012. Unless you opt out: (1) you will only be permitted to pursue claims against PayPal on an individual basis, not as a plaintiff or class member in any class or representative action or proceeding and (2) you will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis. See Disputes with PayPal below for more information.

And here's the opt out process, again copied and pasted straight from Paypal:

  • Opt-Out Procedure.

    You can choose to reject this Agreement to Arbitrate ("opt out") by mailing us a written opt-out notice ("Opt-Out Notice"). For new PayPal users, the Opt-Out Notice must be postmarked no later than 30 Days after the date you accept the User Agreement for the first time. If you are already a current PayPal user and previously accepted the User Agreement prior to the introduction of this Agreement to Arbitrate, the Opt-Out Notice must be postmarked no later than December 1, 2012. You must mail the Opt-Out Notice to PayPal, Inc., Attn: Litigation Department, 2211 North First Street, San Jose, CA 95131.

    The Opt-Out Notice must state that you do not agree to this Agreement to Arbitrate and must include your name, address, phone number, and the email address(es) used to log in to the PayPal account(s) to which the opt-out applies. You must sign the Opt-Out Notice for it to be effective. This procedure is the only way you can opt out of the Agreement to Arbitrate. If you opt out of the Agreement to Arbitrate, all other parts of the User Agreement, including all other provisions of Section 14 (Disputes with PayPal), will continue to apply. Opting out of this Agreement to Arbitrate has no effect on any previous, other, or future arbitration agreements that you may have with us.

I'm sure they're counting on the majority of people not bothering w/ the process. Me, personally, I have my letter stamped and ready to go already.

Saw it, read it and wonder if it is not just easier to let the bank deal with them. They will retract a payment to them and return it to me pending any litigation.

I just don't like giving up my right to a class action lawsuit. You know how sue-happy we Americans are!!! :p

Paypal is Ebay. The only dispute i ever had I got nowhere with them after 2 months. I researched who the local pd and sheriff was and contacted him with a phone call. Had my item within 5 days. Called him back to thank him and he said if more folks followed through there would be a lot less rip off artists getting away with it.

Neither am I. My earlier post was a joke, for the record. HOWEVER...if Paypal fucks up in some major way, I damn sure want the right to be a part of a class action lawsuit if it's needed.

Those "User Agreements" are all well and good, but they are primarily designed to scare people away from trying to sue them. The only person who can actually enforce them is a judge, and there are plenty of cases where, when challenged, and judge will rule that just because a company put something in one of these agreements and people clicked "OK" that they are not legally binding. If a judge chose to accept a class-action suit against Paypal, he could, and no "agreement" form they could show could stop him.

I would like to Donate to Offtopicz but I went to Paypal and was looking it over and no way could I wade through their terms of use. I don't trust them. Is there any other way to donate to Offtopicz?
