Under this new law, a doctor may withhold information, mislead or even blatantly lie to a pregnant woman and her partner about the health of their baby if the doctor so much as thinks that fetal test results would cause a woman to consider abortion.


admittedly I have not read the law, but I trust CNN as a news source, and its two thirty am (or ridiculous o'clock) but seriously? C'mon Oklahoma we have more sense than that! I am abundantly glad I am not having more children if my state thinks it's ok for my doctor to lie to me if my unborn child could have a life threatening condition, i'd bet, had I been pregnant in Oklahoma in 2008 with this new bill that my doctor could have told me my condition wasn't severe because what I had and will most likely have should i ever become pregnant again is so severe it causes many women to abort. not that I would ever abort a baby but for the doctors to be able to just lie to a pregnant woman, as if she has no rights at all is an outrage!

I see this is a two year old article but it was on my FB. I will look after i sleep to see if this has been removed but that fact that it passed the first time still ticks me off

Here's the bill. CNN may be okay as a news source, but the article you read was an opinion piece. ijs

Here's the part that the article refers to:

C. In a wrongful life action or a wrongful birth action, no damages may be recovered for any condition that existed at the time of a child’s birth if the claim is that the defendant’s act or omission contributed to the mother’s not having obtained an abortion.

D. This section shall not preclude causes of action based on claims that, but for a wrongful act or omission, maternal death or injury would not have occurred, or handicap, disease, or disability of an individual prior to birth would have been prevented, cured, or ameliorated in a manner that preserved the health and life of the affected individual.
It's that "or omission" part that damns them, but isn't a doctor prohibited from lying to the patient? Sure, it can be argued that the baby is his patient, too, but the parent makes the decisions for the baby, so that point doesn't hold water. So it seems to me (and I'm no expert) that the law blocks them for suing specifically for wrongful birth or wrongful life, but if they charge something else they can still be compensated. A creative lawyer should be able to work around this.

It does beg the question, though: If the doctor suspects a child would be in danger of his parents' abusing or even killing him/her, he has certain obligations to follow to protect the child. Could a zealot doctor use such an obligation to try to incarcerate the mother to prevent an abortion?

Whether for abortion or against, for or against any moral issue.....a doctor should never lie to a patient about their medical condition.

My first impression is wow..allowing a doctor to lie...equals wrong
Then I look at it from this angle...anti abortion angle
I give rights to a baby ..not the mother
Bill protects the baby from its mother...which is right..but the wrong way of doing it{let alone the presumptive guilt of a mother that it will kill its baby}
Mother can determine whether it will keep a baby or not as the baby may not live up to its standards{Example..you baby will have two fingers missing and a short arm...mother aborts}thus taking a life as the baby because it isnt to her standards}
I can see the need for the bill..but the lying is still wrong
All this has arisen from abortion becoming a form of birth control
Solution ...No abortions because you merely dont want a baby
How come when you want the baby its a baby,,but if it is going to 'not be to standards' it suffers a violent death in an abortion process.

I like the idea of protecting the child.....but do no approve of having to lie to do it.
The simple solution is to outlaw abortion at will.

Its all rather sad..there have been many children born with issues that "grew out of it" or were operated on later etc...that were told they would have a problem child...many times however after the mother has had the baby..they could care less about the issues with the baby...and just love this shit out of it anyway...Its essentially the way we are wired.....These conservatives are starting to look like good people as they are willing to go to great lengths to protect a child
