I'm freaking pissed...today we went to move stuff out of our old apartment...the lease is up today and we were still paying rent there even though we had already moved, we were keeping our old furniture there since we were still paying for the rent and the leasing office told us this was ok...so we get to the apt and the door is unlocked, and most of our stuff was gone. The stuff that was still there was damaged and had paint all over it. We went to the leasing office and they said we needed to talk to the manager, and that they had people moving in there this week...I'm trying to get ahold of a lawyer right now, we had about $5,000 worth of antiques and furniture in there...grrrrrrr!

I am so sorry to hear that. You are doing the right thing by getting a lawyer involved. I am sure they should be held liable for that since they are the ones who obviously unlocked the door. I wish you the best of luck with that.

yeah. the only thing is that most of the furniture is heirlooms, from my boyfriends DEAD MOTHER. It meant a lot to us and I don't see how they could jsut take it! I am not even going to talk to the manager, I'm calling a lawyer before I say shit to them. The lady in the leasing office was really nice and told us "now you guys didnt hear me say this, but they are gonna try to screw yall over". SOOO fucked up. GRRR.

That's horrible. I'm sorry for you and your boyfriend. Is it possible that the managers or somebody who works there did this, and took the things that were worth money? I know there is probably no way of knowing that, but it seems really suspicious that the door was unlocked, not kicked open. If criminals had taken it, the door would have been kicked open. So it had to be somebody with a key. I'm guessing that the spray paint on everything afterward is just a way to cover up what they did. No criminal I've ever heard of, unlocks a door, steals valuables, and then spray paints the rest. People who spray paint furniture/walls/etc., generally kick down the door or break the window. I think it sounds like somebody tried to cover up their crime by spray painting things after the fact.

Btw, you should have made a police report as soon as you saw what had happened. It's not too late to make one. You can't get anything back without making one.

I'm real sorry to hear about that...thats really fucked up shit...I cant believe they did that especially since you were still paying..... 2nd the advice to file a report. It makes you look more valid. Best of luck to getting the stuff back if possible. My bfs boss is married to a lawyer let me know if theres anything we can do to help....He (the lawyer) would have no prob answering questions

They are right, If you were still paying Rent, Then file a police Report, Maybe you might get lucky and the manager still has some of the things stashed away somewhere hoping to sell it later..

I would be pissed to, File Charges

If you're not living there, and still paying, it's still technically your apartment. I would do what you've already done, and filed a civil lawsuit.

well i talked to my uncle who is a lawyer here in town...and just to clarify, the stuff wasn't spray painted, but there were buckets of paint laying around and the walls were freshly painted...they had painted the walls and spilled that paint on the stuff that was there. So I know it wasn't criminal activity, it was the apartment people. My uncle says I need to call them monday and make SURE that they dont have the stuff stored away someplace else for while they were painting (even though the stuff that WAS still there was damaged!). The next step is small claims court. He says he will represent us for free and walk us through every step of the process...he also said that since they are a corportation they usually will have to hire expensive lawyers, and they usually will opt to settle out of court. But I will DEMAND every cent of rent we have paid since the last day we lived there, or they are going to court for sure. The lady at the apts told me that they cleaned stuff out on the SIXTH which is nowhere near the day when our lease was up...so if I have to subpoena records i will! These people are gonna get BURNT!!!!

I don't think they'll give you everything you paid, but they will give the last month rent, including damages. You're not going to get your full rent term refunded.
