Guilty or Innocent?

A father who lost his two young sons in a traffic accident has now been charged with killing the driver responsible.

On December 7, 2012, at about 11:30pm, David Barajas was traveling on County Road 144 in Brazoria County with his family when their truck broke down. Barajas and his two sons, David, 12, and Caleb, 11, were pushing the truck when a car rear-ended their vehicle.

One boy died at the scene, and the other was flown to a hospital in the medical center, where he was pronounced dead. Barajas suffered non life threatening injuries.

Jose Banda, the driver of the car which crashed into the family's pickup truck, was shot once in the head and was also flown to the medical center, where he later died of his injuries. Banda, 20, was determined to be intoxicated at the time of the crash, with a blood alcohol concentration of 0.175, according to the Brazoria County Sheriff's Department.

Officials say witnesses saw Barajas walking away from the scene of the accident and towards his nearby home, shortly after the crash. Those witnesses also reported David Barajas return to the scene and approach Banda's car when the gunshots were fired.


Investigators say they found a handgun holster and ammunition inside the Barajas home, no firearms were found.

Barajas, 31, has been charged with murder in the death of Jose Banda. He was arrested and processed through the Brazoria County Detention Center on $450,000 bond.

As much as I don't like the idea of murder, I cannot say that I wouldn't have done what this man did. He is innocent due to temporary insanity in my book!

To the original question. It sounds like he is guilty of murder. Was it justified well now there is the question worth asking. We cannot take the law into our own hands but as a father I would have a hard time passing sentence on the dad for what he did.

Woah..............all I can say is wouldn't want to serve on that jury and my heart goes out to him....., but if he has a wife that sure as hell didn't hell her any did it?

I fully agree with you AuFred!

A few years back someone rear ended me with my oldest daughter in the car, i think the exwife was prego with our second one and it literally took everything i had not to beat the living crap out of that dude. Seeing the look on his face when i got out of the car ready to whoop some ass made me realize that id be putting myself in a worse situation by doing anything to a man who simply made a driving mistake.

If he had not taken matters into his own hands chances are charges would have been brought against the intoxicated driver.

The answer is obvious. The man is guilty of murder.

Was it justified?

Only if Mr. Banda intentionally tried to hit the vehicle and the father was shooting to stop the car's driver.

I get tired of people praising the system. It may be the best we have have, but it's broken. No doubt about that.

If Mr. Banda was under the influence and drove his car he is liable for the two kids deaths. But he would have gotten off with just a small amount of years if any and no compensation to the father of the two child not even enough to bury them.

Sure the father is guilty of the death of Mr. Banda but it was obvious temporary insanity because of the short time between incident but he will have to go through hell to prove it.

I can't say I wouldn't have shot him right there. Honestly neither one of his children would have wanted him to kill them man and then ruin what life he has left.

He'll get off, I believe, due to "temporary insanity." Now if he had waited months and months and then shot him inside the courtroom or something like that, then we're looking at pre-meditation. But as the facts are laid out here, I think he'll get off. I'd be surprised to see him go to trial, actually...DA should plead that one down.
