I got into a car accident on september 2nd 2007 which is the accident i reffered to on my post involving the car accident. This cop was EXTREAMLY rude. This is the whole story.
I was at a T intersection. It was 2am. I clearly had my work uniform on as I was returning from work. I had one passanger with me, he was 18 and also had his work uniform on. I got into a collision, as i had a flashing red light and the other person had a flashing yellow light.
My car got T boned. This guy was going atleast 80 MPH. No matter what happens though I am at fault. My arm was badly hurt, the pain was very terrible, My door crushed into my forearm. His SUV hit me then he could still control it and was able to pull over(but ended up one wheel on the curb). My car was hit so hard it flew across the intersection. Within minuites a cop comes.
I dont have health insurance rightnow so I cant afford an emergency room visit. At the time I did not know what was wrong so i tried as hard is i could to ignore the pain. She asked if I speaked english. I said "Yes". She asked if I was alright. I reluctantly said yes. She went to go ask the o0ther guy if he was alright. She then came back and asked me again if i spoke english. At this point im pretty pissed. Its a combination of me repeating myself and the terrible pain. I said "Nope, I cant speak english I only speak spanish so im going to need a translator or something". She walked away smiling and I was still pissed.
She called like 5 more cop cars to the scene. My car was totalled. I was royalled fucked. She talked to the other guy for like 30 minuites. And she only talked to me for like 2 minuites. She made me take a test to see if i was drinking but she didnt do it to him. One minuite she tells me the accident is his fault, the next minuite she tells me "Sorry to burst your bubble, but the accident is your fault now." Im just like what the fuck...
She asked me where I was going. I told her I was coming home from work. Under maryland law I can drive late at night if I am coming home from work. She said OK.
She grabbed my licence and my insurance card. she then got a witness account from the OTHER CAR not mine. Then my parents come to get me. This bitch wasnt even there to see the accident but she somehow is able to write me 4 ticket's. She told me straight up, "Your licence is now revoked, you will never drive again in the state of maryland." right to my parents. My parents are like what the hell....? It was my first ticket and I have been driving for around 6 months now with no tickets. She then takes my licence from me, and tells me i wont get it back.
She then asks my parents if she can search the car. My dad said go ahead. She pretended she found weed to try and get me to do a confession or something. I was like there is no weed in the car. Show it to me. She was saying 'Fess up boy! Where is the rest?' Then when My dad walks towards the back window to look in and seese her not touching anything. She then walks away from the car like nothing happned. She mentions the car will be towed and to call the number she gave us on tuesday.
Theese are the tickets she wrote to me.
1). Breaking provisional licence.....What the hell i was coming back from work and had proof of it. Under MD law i can drive to and from work no matter what the restriction says.
2). Failure to control speed resulting in collision....What the hell i was at most going 20MPH around the turn, my wheels were turned during the crash. Shows I was able to control my speed, the other motherfucker couldent dontrol his speed.
3). Driving through a red light....What the hell... i stopped and she wasnt even there to see if i did or did not. She ASSUMED i did not and wrote me one.
4). Failure to yield to another vehicle.... Yeah how the hell do you know..Look how his car has a dent and mine is totalled and I basicly dont have door's. My engine was rammed, and I had transmission fluid leaking everywhere. Come on now, tell me who really was at fault.
Walking back to the car i told my parent's, and it ends up they immideatly drove me to the ER. I feel like a dumbass that maybe she could have mellowed out if I would have told her I was injured. Did i mentiod all the tickets total to 490$?
Im taking her to legal court no doubt. But how can I prove my point. She has a badge and I dont. What can i do? To the court im the average reckless teenage driver going carelessly on the road. They are gonna believe her saying aliens are taking over before they belive me about the accident.
By the way i went to the MVA they gave me a new licence for 20$. It wasnt revoked or suspended or anything. And i talked to the state trooper there he said she cant just take my licence like that on the roadside. She can only do it if im caught drinking and driving, and/or she thinks im mentally or phisically inable to control a vehicle and if that is the case she has to fill out a form and give me a copy(which she didnt). I even asked an attorney and he told me the same thing.
Do you think its a winnable case? And do you think i can get her in trouble for taking my licence at roadside for no reason?
