NEW YORK, July 7 (UPI) -- A New York appeals court has vacated the felony convictions of a couple convicted of starving their young daughter by feeding her a vegetarian diet.
Joseph and Silva Swinton are expected to be released from prison soon, the New York Daily News reported.
Ice Swinton, the couple's daughter, is now 6. She and a brother who was born after the parents' 2002 arrest have been living with relatives.
When the little girl was 16 months old, she weighed only 10 pounds and had a distended stomach, apparently a consequence of the diet she was given.
The couple are to be re-sentenced for misdemeanors and are expected to get time served.
