[h=2]A 12-year-old girl is suing her school in Minnesota after being forced to hand over her Facebook password and punished for posts she made on the social networking site. [/h]

The case has been brought by the American Civil Liberties Union (ACLU), and comes amid growing concern in the United States about individuals' ability to keep their email and other online accounts secret from their school, employer and government authorities.



A number of prospective employees have complained that they were forced to hand over their passwords to Facebook and Twitter when applying for jobs.



In the Minnesota case, the 12-year-old girl, known only as RS, is said to have been punished by teachers at Minnewaska Area Middle School for things she wrote on Facebook while at home, and using her own computer.



The ACLU is arguing that her First and Fourth Amendment rights, which protect freedom of speech and freedom from illegal searches respectively, were violated.


She is said to have been punished with detention after using Facebook to criticise a school hall monitor, and again after a fellow student told teachers that she had discussed sex online.



Legal papers, filed by the ACLU say: "RS was intimidated, frightened, humiliated and sobbing while she was detained in the small school room," while school staff and a sheriff's deputy read her private messages.

It went on: "RS was extremely nervous and being called out of class and being interrogated." The lawsuit says that the mother of RS had not given permission for the viewing.


A spokesman for the school district said: "The district is confident that once all facts come to light, the district's conduct will be found to be reasonable and appropriate."


The case highlights growing concern in the US about the extent to which supposedly private communications can be kept from those in authority.


The ACLU recently forced the Department of Corrections in Maryland to stop requiring applicants to provide their Facebook passwords when applying for jobs.


The Union claims job seekers are now asked to "voluntarily" log into their accounts during interviews, displaying potentially embarrassing photographs and messages. Most comply because they are afraid they will otherwise miss out on the job.


The Department told the ACLU it was seeking to weed out applicants with links to gangs.

In an recent investigation, the TV station MSNBC found that many university sports departments now require students to "friend" their coach, giving officials access to their "friends-only" posts.


The University of North Carolina handbook reads: "Each team must identify at least one coach or administrator who is responsible for having access to and regularly monitoring the content of team members' social networking sites and postings.


"The athletics department also reserves the right to have other staff members monitor athletes' posts."

Even if the girl is posting stuff about killing someone.
I think the school should get the pants sued off them. A right is a right. They cannot teach that you obey the laws and then turn around and do what they want regardless of what ever they think if they are going against rights and laws. There were other ways to punish or investigate the person with breaking rights and laws. The could have asked her legal guardian to resolve the matter if there even is one.

I remember what is was like at my schools and in 1st grade I had a nun smack me on my knuckles with a wooden yard stick only once and my hand was bleeding
it was cause I would talk. It was my first day of school and I was shy.
several days later got spanked on bare skin behind outdoors in front of other kids for another kid lifting her skirt and I just happen to be the first kid she saw when she turned around

4th grade had a male teacher that looked like jack from 3s company take me in the hall and bang my head against the wall for bringing a health book that had all the human anatomy in it some other kids looked it and found the female and male parts and I had no idea about what he was punishing me for
he got fired the next day apparently he had been under investigation for abusive behavior and putting his hand down 4 different 4th grader girl's shirts telling them he would give them good grades

should I go on ....got tons and tons more without bring the police into it that is a whole other story and its longer

Quite frankly, school administrations think they are the Gestapo when it comes to the kids they are "educating". I can't list the number of names of teachers I'd like to run into now and hand 'em a piece of what they've got coming. Comprehending the school work is bad enough, throw in an oppressive environment and it's no wonder kids drop out the first chance they get.

That's ridiculous. What she does at home is the business of her and her family, unless it effects others. And when I say that, I mean, it should be severe enough that the police would get involved

Companies forcing employees to hand over facebook and twitter passwords is messed up too. Might as well make employees hand over the keys to their house so companies can snoop there too.

Oh hell no. If I was the kids parent, I would have walked into the Principals office the next day with a tape measure and started measuring things, and when asked what I was doing....responded with... "Oh, just measuring the place for when I own it"

That's incredibly stupid.

If I was asked to hand over my FB password in an interview, I would tell them to keep looking, the job isn't for me.

Ha ha ha ... Love the style..

I remember going to my daughters school, after an issue arose, and sitting very still and very straight faced with little emotion as my now ex was very frazzled..

When I spoke I did so with few questions but with authority..

The teacher spoke like she was queen shit and she yakking about calling the Ministry of Children Welfare about our daughter being over medicated..

I asked her what her expertise in medication administration was ?

She promptly replied she has Great knowledge on how to give kids medication and knew our daughter was over medicated..

I asked if our daughter was allowed to eat food other than lunch time.

She replied NO, that she was not special and had to be treated like EVERY other kid..

So I follow up very calmly and said "You give my daughter a harsh medication upon arriving at school and don't let her eat something. I thought you knew how to administer medication as it says right on the bottle to give with food"..

The principal flew right off the handle with her as she admitted her error and now being caught red handed..

Never, ever lose your cool.. :cool

It's a two way street.

People seem to forget about how students like to screw around with teachers on Facebook assuming their identities.

Jaybird, that's the difference between you and I. Depending on what my child wrote on face book, they may have more to worry about than the school.

I see no problem with someone looking at someone's FB page and looking it over since any posting that are done are now public ......

HOWEVER

To demand Passwords to view private messages that are between only certain people is a HUGE difference! This is absolutely WAY outside the authority of any school (without parental or guardian consent) or work place. If the girl wrote something inappropriate on her FB wall that could be seen by anyone then she should expect whatever consequences could come from it ... but to have it looked at by forcing her to give up her password? Not okay!
