So, I STILL have yet to recieve ANYTHING frm my wedding photographer. She was supposed to send me some changes to my wedding album for me to look over, and then send the album pages off to the printing press. Everytime I get ahold of her, which is very difficult, she has another excuse, and I'm fucking sick of her shit. I am so very sad that I have NOTHING to show for my wedding, except the pictures my sister took. So this is an email I wrote her, I don't think she even deserves another chance...I haven't gotten ugly with her yet, but I have been very blunt with her. That is about to change though.

What do you think about this email? how would you word it differently?

Hi Kathy, I last heard from you on Feb 28. It is now April, and you still have YET to send me my album changes via email, or my proof book in the mail, or ANYTHING else that I am supposed to recieve. I know you have told me that after you send the album pages to press that it will take 12 weeks for the printing company to turn the order around, do you realize that by that point, even if you send it today, it will be over a year past my wedding? This is beyond frustrating for me, that you act like such a nice person when I hand you money for a service, and recieve nothing that is promised to me. I can't have another wedding. I am very very sad that I have nothing to show at all for my wedding. If I don't recieve anything from you in the next month I am going to take legal action, because I feel like I paid WAY too much money for the lack of service I am receiving!
Please respond ASAP.

Dear Ms. (or Mrs.) __?__:

On <insert date here>, I contracted with you for photo services of my wedding performed on <insert date here>.

As of today, I have not received my proof book nor my album changes (and whatever else it is she was supposed to provide). Given that I was informed that the printing company would require 12 weeks to turn around my order, your lack of attention to our contract is well beyond the time that should have been required to provide me with the service you promised me.

On <insert date here>, I paid you the sum of <insert price here> for your professional service. We communicated last on <insert date here>, yet you have not attempted to provide me with what I paid for, nor have you offered a reason for your delay, nor have you offered me a refund of my payment.

I am requesting a personal phone call or a return e-mail from you immediately upon your receipt of this e-mail. I was happy to have done business with you, but at this point, I am an unsatisfied customer. Please be prepared to make known to me how you are going to resolve my issue. I will be expecting my finished product in my hands before my one year anniversary. A refund of part of my payment to you would also serve to absolve some of my anger and frustration.

Sincerely,

Mrs. Clare __?__

Yep, you are right to have done that hun.

Get any remarks from her always in writing, not email though, apparently they don't hold weight I found out over here. It may be different over there, but you need to check.

Crikey, that is so dispicable that she has not, almost a year later, sorted this out - does she want a business still or is she happy to be penniless?

I do hope you get it sorted and very soon.

Legal action is what's needed - this is not at all acceptable and if she gets funny with you, remind her that it is actually her who has caused this, not you. ;)

I'm with Breathe on this and would send it certified mail instead of email.

Im with grace and breath on this. I think breaths wording works well. And graces suggestion of certified mail. is key. That way there is no room for the photographer saying they didnt recieve the letter.

That is way beyond ridiculous. That amount of time that has passed. Unheard of. Damn good thing you have the pictures your sister took. Those are very nice tho.

Your email is pretty good and the inclusion of taking legal action ought to attract a prompt response.

Out of curiosity, is there anything by you that may have contributed to the keep back?....Like waiting on you to overview pics and whatnot before?

I'm liking Breath's email draft. Very crisp, includes dates of references and professional.

I would also include.....should the matter go to court I will also be seeking <include compensation for emotional distress (whatever it's legally called)> by virtue of the irreplaceable tangible memories of the occasion for which you had been contracted.

I purposely left out the legal action. My feeling is that the woman knows she is slacking on the contract. Threatening her may make her vindictive. Kill her with kindness. If the time comes, let the lawyer handle the legalese.

Good e-mail from Breath. Definitely do certified mail with return receipt requested and that way she will have to sign for it and they will return the signed receipt to you as your proof. I think it costs a little extra for the return receipt but for your proof you need it.

well i don't really need a lawyer. I think all of this would be handled in civil court, because the amount doesn't exceed $____. Not sure what that number is but I know my $1500 isn't over it. Also, you can't get pain and suffering in civil court : / but i dont think this matter is big enough to take above civil court. Not really sure...I need to do some research. And I have nicely asked this lady for the past 8 months about my pictures, and it's just excuse after excuse. I have tried being nice and I'm pretty sick of it. I think a threat is what she needs. But then again i see the other side, because she could just say "fuck it, and fuck her" and not do anythign else at all. I'm at a standstill in this issue : /
