I spent a 3 day weekend in jail once... I paid too much child support!

That's right, I had two full time jobs and Domestics was accidentally taking full support from both jobs, after 3 months of complaining about it and the system not being able to fix it, there was a bench warrant put out for my arrest.
The computer automatically spits out names of deadbeat dads that need to be arrested. Well my name spit out because I was $3,000 ahead in my payments.... turns out the computer doesn't know the difference between being ahead and being behind.

I had to spend 3 days in jail until I could talk to the judge. When the judge saw my case, he just said "You shouldn't be here" No Shit! took another 6 hours to process me out... I love the domestic relations section

The best part... when they finally fixed it so they weren't taking out too much money, they tell me that I can't get the money back, it's unfair to ask her to give it back, instead, they will lower my future payments by 10% until it catches up...

I've always paid my fair share, never tried to pull one over on the system/my kids... but the system is SOOO unfair to the fathers, I was always treated like shit at the conferences.

I think I might have filed a civil suit against the county for that myself. Pain and suffering, mental anguish, and defamation of character. Also time lost from work.

I would have been ALL over them for that. Ridiculous!

I looked into it and was told that I have no case.

The bench warrant was a mistake and only a judge can overturn it... and they conveniently pick you up Friday after work since the judge isn't back in chambers until Monday... except in my case Monday was a holiday

Who did you ask? I would imagine that falls under wrongful imprisonment.

Wow, that's amazing. So they can just lock people up, hold them, embarrass them, maybe cause them to lose a job .. and it's just "ok" .. and you're told to just "shake it off buddy".

That's just amazing. :( .. that really sucks

that does suck tim :( im sorry you had to go through that! You'd think they'd pay you for being in jail...you know how each day served can go towards $100 of what you owe...yeah well they should have paid you $300 at least for all taht.

Pay me??? hahahah.. they wouldn't even give back the money I over paid into the system...

I guess I could have fought it more... but it was only a week-end and it didn't affect my jobs or anything...

uh .. now that I would fight. I know you need to pay for your kid (I feel the pain of not getting CS myself) .. but you only owe what you owe. If they don't pay it back, your payements should at least stop until you are back where you should be.

I wouldn't care what anyone told me .. I would fight that .. that is not right at all.

uh .. now that I would fight. I know you need to pay for your kid (I feel the pain of not getting CS myself) .. but you only owe what you owe. If they don't pay it back, your payements should at least stop until you are back where you should be.

I wouldn't care what anyone told me .. I would fight that .. that is not right at all.

They wouldn't pay me back (even though I really needed the money) and they wouldn't stop the payments, the best they would do for me is reduce my payments by 10%... which didn't help me all that much

But that could cause you problems financially. Then you could get behind in future payments. And you could get put in jail again. And it would be THEIR fault, again. A person only makes so much money a month.

Did you tell the lawyer this? If so .. I'd talk to a different lawyer. Seriously.

This whole thing was almost 8 years ago. I didn't ever have to worry about falling behind in my payments since they took it from my checks.

I'm not sure you understand that I went to jail because I paid TOO MUCH money... or should I say they took TOO MUCH money from my pay, taking it from both my employers instead of just the one... so I was paying double the amount.

I know .. which could have easily made you get behind in other payments you owed (car, ins, house note, ect). Then you could over draw your checking account. And then they couldn't take anything .. because you wouldn't have the $$ in your account to take. You'd have OD fees everywhere .. and they add up quick. You could be in a hole in no time that way.

It's all heresay in happening, but it could happen :) .. but yeah, if it's been that long .. you aren't gonna get it back lol.

got arrested and spent the weekend in juvi when I was a minor for having a party when my parents were out of town
got charged with assult and battery and disorderly conduct when I was an adult for beating the hell out of my boyfriend and the chick he was cheating on me with when I caught them, but never went to jail just got fingerprinted and had to pay a fine and got the battery charges dropped and went with the disorderly conduct.
